GENERAL- กรุณาให้รายละเอียดบรีฟที่ชัดเจน ครบถ้วน และเป็นระเบียบก่อนเริ่มงาน ไม่รับตัวละครที่มีข้อมูลกระจัดกระจาย ไม่ชัดเจน หรือขัดแย้งกัน
- ไม่รับวาดบุคคลจริงหรือใบหน้าที่อ้างอิงจากคนจริง
- ผู้ว่าจ้างต้องเป็นเจ้าของตัวละครหรือมีสิทธิ์ในการว่าจ้าง (Fanart & Adoptable กรุณาอ่านหัวข้อ 'USE'.)
- ตัวละครที่มีรายละเอียดซับซ้อนมากอาจถูกปฏิเสธ สามารถสอบถามก่อนได้
- ทุกงานจะถูกพิจารณาก่อนรับงาน และขอสงวนสิทธิ์ในการปฏิเสธงานทุกกรณี
- ข้อตกลง เงื่อนไข หรือกฎเพิ่มเติมอื่น ๆ อาจแตกต่างกันไปตามโพสต์ของงานแต่ละงาน กรุณาอ่านรายละเอียดและเงื่อนไขที่ระบุไว้ในแต่ละโพสต์ให้ครบถ้วนก่อนทำการว่าจ้าง
- ข้อตกลง และเงื่อนไขสามารถเปลี่ยนแปลงหรือปรับปรุงได้ตลอดเวลาโดยไม่ต้องแจ้งให้ทราบล่วงหน้าPAYMENTS- ต้องชำระเงินเต็มจำนวนก่อนเริ่มงาน (เว้นแต่ว่างานนั้น ๆ จะระบุเป็นอย่างอื่น เช่น โพสต์นั้น ๆ ระบุว่าสามารถจ่ายครึ่งจำนวนก่อนได้ หรือ เป็นงวด ๆ เป็นต้น)
- ราคาเริ่มต้นไม่สามารถต่อรองได้
- อาจมีค่าใช้จ่ายเพิ่มเติมสำหรับดีไซน์ที่ซับซ้อน การแก้ไขเพิ่มเติม หรือการใช้งานเชิงพาณิชย์REVISIONS- สามารถแก้ไขงานได้ฟรีในช่วง WIP (งานที่อยู่ระหว่างดำเนินการ) สูงสุด 2 ครั้ง (ต้องอยู่ในขอบเขตของบรีฟเดิม)
- ค่าใช้จ่ายเพิ่มเติม: แก้ไขเล็กน้อย (อยู่ในบรีฟ): +10%–30% หรือมากกว่า /
แก้ไขใหญ่หรือแก้นอกบรีฟ: +50% หรือมากกว่า
- กรณีที่ศิลปินวาดผิดจากรายละเอียดที่ระบุไว้อย่างชัดเจน สามารถแก้ไขได้ฟรีในช่วง WIP และภายใน 3 วันหลังส่งงาน (เช่น ลายตัวละคร สีตา หรือเครื่องประดับที่ระบุไว้ในบรีฟ)
- หลังส่งงานแล้วจะไม่สามารถแก้ไขได้ เว้นแต่มีค่าใช้จ่ายเพิ่มเติมDEADLINES AND DELIVERY- ระยะเวลาทำงานโดยปกติประมาณ 1-2 สัปดาห์ต่อ 1 งาน ขึ้นอยู่กับคิว และปัจจัยอื่น
- อาจเกิดความล่าช้าได้จากปัญหาสุขภาพ เรื่องส่วนตัว หรือเหตุสุดวิสัย
- ไฟล์จะถูกส่งผ่านทาง EmailUSE- ผลงานทั้งหมดหากไม่ได้มีการชำระเงินเพื่อใช้ในเชิงพาณิชย์จะเป็นงาน personal use โดยพื้นฐาน
- การใช้งานเชิงพาณิชย์ต้องชำระเพิ่มเติม
- การนำไปใช้เชิงพาณิชย์โดยไม่ได้รับอนุญาต จะมีการคิดค่าปรับ และค่าธรรมเนียมเพิ่มเติม
- โปรดระมัดระวังเมื่อว่าจ้างตัวละครประเภท Adoptable หรือของบุคคลที่สาม หากไม่มีสิทธิ์เชิงพาณิชย์ ผลงานจะใช้ได้เฉพาะส่วนตัวเท่านั้น
- Fanart ใช้ได้เฉพาะส่วนตัวเท่านั้นINTELLECTUAL PROPERTY RIGHTS- ศิลปินถือครองลิขสิทธิ์ผลงานทั้งหมด เว้นแต่จะมีการตกลงเป็นอย่างอื่น
- ต้องให้เครดิต 'Twisteeyn' หรือ 'Twisteeyn_312' เมื่อนำผลงานไปเผยแพร่หรือใช้งาน
- ห้ามแอบอ้างผลงานว่าเป็นของตนเอง
- อนุญาตให้แก้ไขเล็กน้อยได้เฉพาะกรณีที่ยังคงสไตล์เดิม และได้รับอนุญาตจากศิลปินแล้วเท่านั้น
- ห้ามนำไปใช้กับ AI, การเทรนโมเดล, dataset, NFT หรือเทคโนโลยีที่เกี่ยวข้องโดยเด็ดขาดPRIVACY / NDA- สามารถขอ NDA ได้ โดยมีค่าธรรมเนียมเพิ่มเติมสำหรับการรักษาความเป็นส่วนตัว
- ต้องแจ้งขอ NDA ก่อนเริ่มงานREFUNDS- คืนเงิน 100% หากยังไม่เริ่มงาน (ยังไม่เข้าสู่ WIP)
- คืนเงิน 25% หากเริ่มงานแล้วแต่ยังไม่ลงสี
- ไม่คืนเงินหลังจากเริ่มลงสีแล้ว และเมื่อมีการคืนเงิน ผู้ว่าจ้างจะไม่ได้รับหรือเก็บไฟล์งานในทุกกรณี
- การคืนเงินอาจมีการหักค่าธรรมเนียมจากแพลตฟอร์มหรือธุรกรรม
- ศิลปินจะไม่รับผิดชอบค่าธรรมเนียมที่ถูกหักCOMMUNICATION- โดยปกติจะตอบกลับภายใน 1-2 วัน
- ผู้ว่าจ้างควรตอบกลับภายในระยะเวลาที่เหมาะสม เช่น เมื่อมีการส่ง WIP หรือขอการยืนยัน ควรตอบภายใน 3-5 วัน
- การตอบกลับล่าช้าอาจส่งผลต่อกระบวนการทำงานและระยะเวลาโดยรวมของงาน หากผู้ว่าจ้างตอบช้าเกินไปจนเหลือเวลาไม่ถึง 3 วันเต็มก่อนกำหนดส่ง และทำให้ไม่สามารถทำงานได้อย่างสมบูรณ์ ความรับผิดชอบจะไม่อยู่ที่ศิลปิน และคำขอคืนเงินเต็มจำนวนอาจถูกปฏิเสธ อย่างไรก็ตาม หากผู้ว่าจ้างมีเหตุผลที่สมเหตุสมผล จะมีการพิจารณาและตกลงร่วมกันเป็นกรณีไป
- องค์กรหรือบริษัทต้องแจ้งวัตถุประสงค์การใช้งาน และจัดเตรียมเอกสารสัญญาว่าจ้าง และเอกสารอื่น ๆ ที่จำเป็น
- ผู้ว่าจ้างสามารถทักมาสอบถามความคืบหน้าของงานได้ตลอดเวลาBLACKLIST- ผู้ว่าจ้างอาจถูกขึ้นบัญชีดำในกรณีต่อไปนี้:
1. ละเมิด TOS ซ้ำ ๆ หลังได้รับคำเตือน
2. ใช้งานเชิงพาณิชย์โดยไม่ได้รับอนุญาต
3. การละเมิด และปฏิเสธการชำระค่าเชิงพาณิชย์
4. แอบอ้างผลงานว่าเป็นของตนเอง
5. นำผลงานไปใช้กับ AI/NFT
6. มีพฤติกรรมคุกคาม กดดัน หรือไม่เหมาะสม
- ผู้ว่าจ้างที่ถูกขึ้นบัญชีดำจะถูกปฏิเสธการรับงานในอนาคตอย่างถาวร

GENERAL- Please provide a clear, complete, and organized brief before the commission begins. I do not accept characters with scattered, unclear, or contradictory references.
- I do not draw real people or real-life likenesses.
- Clients must own the character or have proper rights to commission it. (Fanart & Adoptable please refer to heading 'USE'.)
- Characters with extremely complex details may be declined; you may contact me to ask in advance.
- All requests are subject to review, and I reserve the right to refuse any commission.
- Additional terms, conditions, or specific rules may vary depending on each commission post. Please make sure to read the details provided in each post carefully.
- Terms and conditions may be updated or changed at any time without prior notice.PAYMENTS- Full payment is required upfront unless stated otherwise.
- Base prices are non-negotiable.
- Additional fees may apply for complex designs, extra revisions, or commercial usage.REVISIONS- Free revisions are available during WIP stages, up to 2 times total. (Revisions must stay within the original brief)
- Additional fees apply as follows: Minor revisions within brief: +10%–30% or more / Major or out of brief revisions: +50% or more
- Mistakes in clearly briefed details can be corrected for free during WIP and within 3 days after completion (such as character markings, eye color, or accessories listed in the brief).
- No revisions after final delivery unless additional fees are paid.DEADLINES AND DELIVERY- Standard turnaround time is 1–2 weeks per commission, depending on queue and external factors.
- Delays may occur due to health issues, personal matters, or unforeseen circumstances.
- Files can be delivery via Email.USE- All commissions are personal use only by default.
- Commercial use requires purchasing the appropriate license.
- Unauthorized commercial use will result in additional fees and possible penalties.
- Please be cautious when commissioning adoptable or third-party characters. If you do not own commercial rights to the character, the commission is personal use only.
- Fanart is strictly personal use only.INTELLECTUAL PROPERTY RIGHTS- I retain full copyright to all artworks unless otherwise agreed.
- Credit 'Twisteeyn' or 'Twisteeyn_312' is required when posting or using the artwork.
- Claiming the artwork as your own is prohibited.
- Minor edits are allowed only if the original style remains recognizable and with prior permission.
- AI usage, AI training, datasets, NFT minting, or similar technologies are strictly prohibited.PRIVACY / NDA- NDA is available upon request and requires an additional privacy fee.
- NDA must be requested before the commission starts.REFUNDS- 100% refund if work has not started. (Still not WIP)
- 25% refund if work has started but coloring has not begun.
- No refunds after coloring has started.Upon refund, the client will not receive or retain any version of the commissioned artwork.
- Refunds are subject to platform and transaction fees.
- The artist will not compensate for any deducted fees.COMMUNICATION- I usually reply within 1-2 days.
- Clients are expected to respond within a reasonable timeframe. Example: when I send a WIP update or request confirmation, clients should reply within 3–5 days.
- Delayed responses may affect the workflow and overall timeline of the commission. If a client responds too late and the delay results in less than 3 full days remaining before the deadline, making it impossible to complete the artwork properly, the responsibility for the delay will not fall on the artist. In such cases, full refund requests will be considered invalid and may be declined. However, exceptions may be made if the client provides a reasonable and valid explanation. Such cases will be reviewed and mutually discussed.
- Organizations or companies must disclose the intended use of the artwork and provide proper documentation when required.
- Clients are always welcome to message me at any time if they wish to ask for progress updates.If you wish to ask for progress updates, please feel free to message me at any time.BLACKLIST- Clients may be blacklisted for the following reasons:
1. Repeated violation of TOS after warnings
2. Unauthorized commercial or monetized use
3. Refusal to pay required commercial fees.
4. Claiming artwork as their own.
5. AI/NFT misuse
6. Harassment, pressure, or abusive behavior
- Blacklisted clients will be permanently refused from future commissions.

GENERAL- เมื่อทำการซื้อ Adoptable คุณจะกลายเป็นผู้ถือตัวละคร (holder) โดยศิลปินยังคงถือครองสิทธิ์ในทรัพย์สินทางปัญญาต้นฉบับ
- การซื้อ Adoptable ถือว่าคุณยอมรับTOS ทั้งหมดนี้
- ไม่สามารถขอคืนเงินได้หลังจากซื้อ Adoptable แล้ว
- ห้ามนำ Adoptable หรือผลงานต้นฉบับไปใช้กับ NFT, AI training, dataset หรือเทคโนโลยีที่เกี่ยวข้องทุกชนิด
- ศิลปินมีสิทธิ์นำผลงาน Adoptable ไปแสดงใน Portfolio ของตน
- ข้อตกลง เงื่อนไข หรือกฎเพิ่มเติมอื่น ๆ อาจแตกต่างกันไปตามโพสต์ของ Adoptable แต่ละงาน กรุณาอ่านรายละเอียดและเงื่อนไขที่ระบุไว้ในแต่ละโพสต์ให้ครบถ้วนก่อนทำการซื้อ-ขาย
- ข้อตกลงและเงื่อนไขสามารถเปลี่ยนแปลงหรือปรับปรุงได้ตลอดเวลาโดยไม่ต้องแจ้งให้ทราบล่วงหน้าUSE & RIGHTS- ห้ามแอบอ้างว่าดีไซน์หรือผลงานเป็นผลงานที่สร้างโดยตนเอง
- เมื่อนำผลงานต้นฉบับไปใช้หรือเผยแพร่ ต้องให้เครดิต 'Twisteeyn_312' หรือ 'Twisteeyn'
- Adoptable ใช้เพื่อการส่วนตัวเท่านั้น เว้นแต่จะซื้อสิทธิ์เชิงพาณิชย์เพิ่มเติม
- ห้ามนำไปใช้เชิงพาณิชย์ (รวมถึงคอนเทนต์ที่สร้างรายได้หรือสินค้าสำหรับจำหน่าย) เว้นแต่จะชำระเพื่อปลดล็อกสิทธิ์ดังกล่าวDESIGN MODIFICATION- สามารถปรับเปลี่ยนดีไซน์ได้ แต่โครงสร้างหลักและอัตลักษณ์ของดีไซน์เดิมต้องยังคงสามารถจดจำได้
- ไม่อนุญาตให้รีดีไซน์เยอะจนเปลี่ยนโครงสร้างดั้งเดิมโดยสิ้นเชิงRESALE & TRANSFER- อนุญาตให้ขายต่อ Adoptable ได้
ราคาขายต่อห้ามสูงกว่าราคาที่ซื้อมาเดิม
- สามารถเพิ่มราคาได้เฉพาะในกรณีที่มีงานคอมมิชชันของตัวละครนั้นเพิ่มเติม
- ผู้ถือครองต้องแจ้งศิลปินทุกครั้งเมื่อมีการโอนสิทธิ์ให้ผู้ถือ Adoptable คนใหม่
- งานที่วาดเอง ทำเอง หรือแฟนอาร์ต จะไม่สามารถนำมาคิดเพิ่มมูลค่าราคาขายต่อได้
- อนุญาตให้ให้เป็นของขวัญ (Gift) และ OTA (Offer to Adopt) ได้ภายใต้เงื่อนไขเดียวกันIMPORTANT NOTES- คำว่า “holder” อาจถูกเรียกว่า “owner” เพื่อความสะดวกในการสื่อสาร แต่ไม่ได้หมายถึงการถือครองสิทธิ์แบบเต็มรูปแบบหรือสิทธิ์แต่เพียงผู้เดียว
- การละเมิดเงื่อนไขใด ๆ อาจส่งผลให้สูญเสียสิทธิ์ ถูกเรียกค่าปรับ หรือถูกขึ้นบัญชีดำ
- Adoptable ที่ถูกซื้อก่อนวันที่ 25/04/2026 โดยทั่วไปจะอ้างอิงตาม TOS/Rules เดิมที่มีผลในขณะซื้อ อย่างไรก็ตาม ศิลปินขอสงวนสิทธิ์ในการบังคับใช้เงื่อนไขฉบับปรับปรุงในกรณีที่เกี่ยวข้องกับการคุ้มครองลิขสิทธิ์ การนำไปใช้ผิดวัตถุประสงค์ การละเมิดสิทธิ์เชิงพาณิชย์ การใช้กับ AI/NFT หรือการละเมิดนโยบายร้ายแรงอื่น ๆ

GENERAL- By purchasing an adoptable, you become the holder of the character. The artist retains the original intellectual property rights.
- Purchasing an adoptable means you agree to these terms.
- Refunds are not available once the adoptable has been purchased.
- The adoptable and its artwork must not be used for NFT minting, AI training, datasets, or any related technologies.
- The artist retains the right to display the adoptable artwork as part of my portfolio.
- Additional terms, conditions, or specific rules may vary depending on each adoptable post. Please make sure to read the details provided in each post carefully.
- Terms and conditions may be updated or changed at any time without prior notice.USE & RIGHTS- Do not claim the design or artwork as your own creation.
- When using the original artwork, credit 'Twisteeyn_312' or 'Twisteeyn' is required.
- The adoptable is for personal use only unless commercial rights are purchased.
- Commercial use (including monetized content or commercial merchandising) is strictly prohibited unless paid to unlock.DESIGN MODIFICATION- Design changes are allowed; however, the core structure and identity of the original design must remain recognizable.
- Major redesigns that completely alter the original structure are not permitted.RESALE & TRANSFER- Reselling the adoptable is allowed.
- The resale price must not exceed the original purchase price.
- No price increase is allowed based on self-drawn artwork, fanart, or additional artwork of the character.
- Price increases are only allowed if the current holder has purchased commissioned artwork of the character (commissioned art).
- The holder must notify the artist every time ownership is transferred to a new holder/owner.
- Gifting and OTA (Offer to Adopt) are allowed under the same conditions.IMPORTANT NOTES- The term “holder” may sometimes be referred to as “owner” for convenience, but this does not grant full or exclusive ownership rights.
- Any violation of these terms may result in loss of rights, penalties, or blacklisting.
- Adoptables purchased before April 25, 2026, will generally follow the original TOS/Rules in effect at the time of purchase. However, the artist reserves the right to enforce updated terms in cases involving copyright protection, misuse, commercial violations, AI/NFT-related misuse, or other serious policy breaches.
